HTTP bitrate switching doesn't do the LOAD switch

So the player is still trying to play the H.264 TV video instead of the H.264 Web.
Once my college jumped to the next item in the play list the quality monitor showed: bandwidth: ~400 kbps level: 3 of 3 (370kbps, ???px)
The video played fine, even on his slow connection.
I am unfortunately unable to make further tests tonight. I will be able to test on more connections tomorrow.
Do you think this problem is happening because the initial still images of our video are not using enough bandwidth in the first 2 seconds to force the player to switch as they are still images? Should we change the first 2 seconds to a graphic or footage that uses more bandwidth to get more consistent bitrate detection?
